- Prohibition

43

Do not strike any Jewish person

This prohibition is derived from “Forty lashes he may be given but do not add more” Devarim Ki 25: 3

This prohibition not to strike any Jewish person is derived from the inference of reasoning from the lessor to the greater.

When someone is punishable by lashes according to the Torah, Scripture commands us not to add anything to the beating, how much greater does this apply to other people.

If someone hits another person and causes damages of less than a coin of minimal monetary amount he is to be lashed.

If the damages amount to more than this, he pays in money but is not lashed.

One who raises one’s hand to another is called “wicked”

Punishment in the course of discipline or education is not a transgression.
